TERMS AND CONDITIONS

Freeride Lodge Bakhmaro LLC (Freeride Lodge Bakhmaro).

These Terms and Conditions govern all bookings, tours, guiding services, accommodation packages, courses, and activities offered by Freeride Lodge Bakhmaro. By making a booking, you acknowledge that you have read, understood, and accepted these Terms and Conditions.

1. Booking and Payment

To make a reservation, please contact Freeride Lodge Bakhmaro by email or through our booking channels.

A binding contract is formed when:

A deposit of 30% of the total booking price is required to secure your reservation.

For bookings made within 60 days of the activity start date, full payment is required at the time of booking.

The remaining balance must be paid no later than 60 days before the scheduled start date.

If the balance is not received by the due date, and no alternative arrangement has been agreed in writing, we reserve the right to cancel the booking and apply the cancellation charges outlined below.

2. Cancellation and Changes

All cancellations must be submitted in writing by email and become effective upon receipt.

Client Cancellations

We strongly recommend purchasing comprehensive travel cancellation insurance.

No booking changes can be made within 60 days of the activity start date unless expressly agreed by Freeride Lodge Bakhmaro.

Cancellation by Freeride Lodge Bakhmaro

We reserve the right to cancel a tour, course, or activity due to insufficient participant numbers, safety concerns, force majeure, or other operational reasons.

Where possible, participants will receive at least 30 days' notice and may choose between:

Freeride Lodge Bakhmaro shall not be liable for any additional expenses incurred by participants, including flights, accommodation, equipment rental, or other travel-related costs.

Early Departure

If a participant voluntarily leaves, withdraws from, or terminates a tour, course, or activity after it has commenced, no refund will be provided.

3. Courses, Guiding and Activities

Mountain environments are dynamic and conditions may change rapidly.

Freeride Lodge Bakhmaro and its guides reserve the right to modify, shorten, postpone, relocate, or cancel any activity where necessary for safety reasons, including but not limited to:

No refund shall be due where reasonable modifications are made in the interests of safety.

Private Guiding

Private guiding services operate in all weather conditions whenever reasonably possible.

Guides may adjust the itinerary or objectives to suit prevailing conditions.

If both the participant and guide agree that an activity cannot reasonably proceed and the guide waives their fee, the guiding fee will be refunded.

Group Courses

Group courses and training sessions will proceed regardless of weather conditions unless safety considerations make this impossible.

Guides may alter the venue, itinerary, or objectives to suit participant ability and prevailing conditions.

No refund shall be payable where such modifications are necessary.

4. Assumption of Risk

Participation in skiing, snowboarding, ski touring, cat skiing, mountaineering, climbing, trekking, and other mountain activities involves inherent risks.

These risks include, but are not limited to:

You agree to follow all instructions provided by guides, instructors, drivers, and staff members.

Failure to comply with safety instructions may result in immediate exclusion from the activity without refund.

5. Participant Fitness and Equipment

Participants are responsible for ensuring they:

Freeride Lodge Bakhmaro reserves the right to refuse participation or remove any participant whose fitness, ability, behavior, or equipment may compromise safety.

No refund shall be be provided in such cases.

6. Insurance

All participants must have valid travel and mountain sports insurance covering the activities booked.

Insurance should include, at a minimum:

Participants are solely responsible for ensuring that their insurance policy adequately covers the activities undertaken.

Freeride Lodge Bakhmaro accepts no responsibility for costs resulting from inadequate or missing insurance coverage.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Freeride Lodge Bakhmaro, its employees, guides, contractors, and representatives shall not be liable for:

arising from participation in activities, except where such loss results directly from gross negligence or wilful misconduct by Freeride Lodge Bakhmaro.

Participants join all activities at their own risk.

8. Force Majeure

Freeride Lodge Bakhmaro shall not be liable for delays, changes, interruptions, or cancellations caused by circumstances beyond its reasonable control, including:

9. Complaints

If you have a complaint during your stay or activity, you must notify your guide or a member of staff as soon as reasonably possible. This allows us the opportunity to address and resolve the issue promptly. Any complaint not reported during the activity may limit our ability to investigate and resolve the matter.

10. Governing Law and Jurisdiction

These Terms and Conditions and any contract between the participant and Freeride Lodge Bakhmaro LLC shall be governed exclusively by the laws of Georgia.

Any disputes arising from or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the competent courts of Georgia.

11. Minimum Participant Numbers

Certain tours, courses, and cat skiing programs require a minimum number of participants to operate. If the minimum number is not reached, Freeride Lodge Bakhmaro reserves the right to cancel or modify the program.

In such cases, participants will be offered either:

12. Avalanche Safety Equipment

For all off-piste, backcountry, ski touring, and cat skiing activities, participants are required to carry and use the safety equipment specified by Freeride Lodge Bakhmaro.

This may include:

Participants are responsible for ensuring that their equipment is in proper working condition unless rented from Freeride Lodge Bakhmaro. Guides reserve the right to exclude any participant who does not possess the required safety equipment or is unable to use it safely and correctly. No refund shall be provided in such cases.

13. Alcohol and Drug Policy

The consumption of alcohol, illegal drugs, or any substance that may impair judgment, coordination, or physical performance before or during any activity is strictly prohibited.

Freeride Lodge Bakhmaro reserves the right to refuse participation or remove any participant who appears to be under the influence of alcohol, drugs, or any other intoxicating substance. No refund shall be provided to participants excluded under this policy.

14. Photography and Media

During tours, courses, and activities, photographs and video recordings may be taken by Freeride Lodge Bakhmaro, its guides, employees, contractors, or authorized media partners.

Unless a participant notifies Freeride Lodge Bakhmaro in writing before the start of the activity, such images and recordings may be used for promotional, marketing, educational, editorial, and social media purposes without compensation.

Participants who do not wish to appear in photographs or videos must inform Freeride Lodge Bakhmaro before the commencement of the activity.

15. Equipment Rental

Participants renting equipment from Freeride Lodge Bakhmaro are responsible for returning all equipment in the condition in which it was received, subject to normal wear and tear.

Participants shall be liable for loss, theft, negligent damage, or destruction of rented equipment and may be charged the repair or replacement cost.

Freeride Lodge Bakhmaro accepts no responsibility for injury, loss, or damage arising from the misuse of rented equipment.

16. Emergency Rescue and Evacuation Costs

Participants acknowledge that mountain activities may require emergency rescue, medical treatment, evacuation, or helicopter assistance.

All costs associated with rescue operations, evacuation, medical treatment, transportation, hospitalization, repatriation, and related services shall be the sole responsibility of the participant and/or their insurance provider.

Freeride Lodge Bakhmaro accepts no liability for such costs.

17. Language

These Terms and Conditions may be translated into other languages for convenience.

In the event of any inconsistency, discrepancy, or dispute regarding interpretation, the English version shall prevail and be legally binding.

18. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

19. Acceptance of Terms

By making a booking, paying a deposit, or participating in any activity organized by Freeride Lodge Bakhmaro LLC, the participant confirms that they have read, understood, and accepted these Terms and Conditions in their entirety.
